Construction Permit Application

Any homeowner/landowner desiring to construct any dwelling or any structure in Royal Pines Estates shall first secure written approval from the Royal Pines Homeowners (RPHA) Board for the construction project.  This authority was granted to the RPHA Board in Article IV of the Plat (Dedication) and under paragraph 15 (f) of the Bylaws.  Construction shall include but not limited to grading, paving, placing signs, building additions or alteration, decks or fencing, out buildings, sheds and garages, and any other project that requires a building permit from other local governing authorities.

The RPHA Board shall to the best of its ability, balance the interests of land owners within Royal Pines Estates in the free exercise of their rights to the property they own against the interests of the subdivision as a whole, the need to preserve the property values and maintain a cohesive, peaceful, and attractive neighborhood.  It is recognized that advancements in technology, engineering, and architectural designs, it is necessary and appropriate to modify from time to time previous limitations on design and materials used in construction.  The Board  may at its discretion approve different materials which may be appropriate to maintain the appearance of structures in terms of  compatibility of the adjacent dwellings and general appearance of the subdivision.

The RPHA Board may deny the request if there is not sufficient  information about the construction project included, if the request is inconsistent and adversely effects the character of the subdivision or its residents or any other applicable reason.

As a homeowner/resident of Royal Pines Estates I am hereby requesting approval from the RPHA Board of Directors to construct the following on:

Please also attach the following:

 

  1. A somewhat to scale drawing of your lot(s) showing the location of your Home and the construction project.

  2. Indicate on the drawing the distance (feet) from your property lines to the proposed construction.

  3. Information about your project ie’ material used, size, color, foundation material or any other applicable information.

  4. If this application is for a outbuilding or shed will it be on a permanent foundation (concrete).

This application can be given or mailed to any Board Member.  The Board will make every effort to act on your request in 30 days.  After an initial review by the Board the applicant may request that they present their application to the Board in person.

Board Approval

 

By the approval of this Request the RPHA Board shall not be deemed to have warranted or approved the request for engineering or structural design safety or compliance with building or zoning requirements.  By approving such plans and specifications neither the RPHA Board  or any of the Association Members assumes any liability or responsibility for any defect in any structure constructed from the approved plans and specifications.  The RPHA Board or its members shall be not be liable for any owner or other person for any damage, loss or prejudice suffered or claimed on account of the approval or disapproval, of plans or specifications, quality of construction and performance of this construction project.

The aforementioned approval is only from the Royal Pines Homeowners Association.  Any other permits or approvals required from the Corp of Engineers, State of Kansas, Osage County or any other governing bodies are the sole responsibility of the applicant/homeowner.  By this approval the RPHA Board assumes no liability if the applicant does not obtain the required approvals.
